Welcome to Baker’s Kitchen. The terms “we,” “us,” and “our” refer to Baker’s Kitchen.

Baker’s Kitchen operates this store and website, including the information, content, features, tools, physical products, digital products, and services offered through it (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They contain important information concerning your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

Section 1 — Eligibility, Access, and Accounts

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or country of residence or that you have the legal authority to enter into these Terms.

When using the Services, you may be asked to provide information such as your name, email address, billing information, payment information, and shipping address. You represent that the information you provide is accurate, current, and complete and that you have the authority to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account to another person.

Section 2 — Products and Product Information

We make reasonable efforts to describe and display our products accurately. However, product colors, dimensions, packaging, materials, and appearance may vary slightly from photographs or from how they appear on your device.

Measurements, capacities, weights, and other product specifications are approximate unless expressly identified as exact. Product packaging and included components may change when reasonably necessary without materially reducing the product’s function or value.

We may update product descriptions, prices, specifications, availability, and packaging or discontinue products at any time without notice. We may also limit the quantity of products available to any person, household, geographic area, or jurisdiction.

Nothing in these Terms limits rights or remedies that cannot legally be excluded.

Section 3 — Starter Cultures, Food Products, and Baking Results

Sourdough starter cultures are living biological products. Their activation, development, aroma, appearance, and performance can vary depending on factors outside our control, including temperature, water quality, flour, feeding schedule, sanitation, storage, elevation, and handling.

Activation times and baking timelines are estimates, not guarantees. Individual results will vary, and we do not guarantee that every starter or recipe will produce a particular rise, flavor, crumb, texture, appearance, or finished loaf.

Customers are responsible for following the instructions supplied with the product, using clean equipment, storing ingredients appropriately, and exercising ordinary food-safety practices. Do not consume a starter or food product showing visible mold, unusual discoloration, contamination, or a rotten or otherwise unsafe odor.

Ingredient and allergen information should be reviewed before purchase and use. Products may be manufactured, packaged, stored, or handled in environments where common allergens are present. Contact us before purchasing if you have questions about a particular product.

Information supplied through the Services is for general educational purposes and is not medical, nutritional, or professional food-safety advice.

Section 4 — Orders and Acceptance

Submitting an order constitutes an offer to purchase. An automated order confirmation acknowledges that we received your order but does not necessarily mean that the order has been accepted.

We may accept, reject, limit, or cancel an order for legitimate reasons, including suspected fraud, payment problems, pricing or inventory errors, shipping restrictions, unusually large quantities, or suspected unauthorized resale.

Payment must be authorized and processed before an order is fulfilled. If we reject or cancel an order after payment has been processed, we will issue an appropriate refund.

Review your order carefully before submitting it. We may be unable to change or cancel an order after processing or fulfillment begins.

Products purchased through the Services are intended for personal or household use unless we expressly agree otherwise. You may not purchase products for unauthorized commercial resale, export, or redistribution.

Returns and refunds are governed by our Return and Refund Policy.

Section 5 — Prices, Payments, and Billing

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is placed, subject to correction of obvious errors.

Unless stated otherwise, displayed prices do not include shipping, handling, customs duties, import charges, or applicable taxes. Customers are responsible for charges imposed by their destination country or jurisdiction unless those charges were collected during checkout.

Prices offered through this website may differ from prices offered through marketplaces, retail partners, physical events, or other sales channels.

Promotions may be subject to separate conditions. If promotional terms conflict with these Terms, the promotional terms control for that promotion.

You agree to provide accurate, current, and complete billing and payment information. You represent that you are authorized to use the payment method submitted and agree to pay all authorized charges associated with your order.

Section 6 — Shipping and Delivery

Processing and delivery dates are estimates and are not guaranteed. Delays may occur because of carrier operations, weather, customs, supply interruptions, inaccurate addresses, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Additional shipping costs caused by an incorrect or incomplete address may be your responsibility where permitted by law.

Risk of loss or damage passes to you when the order is delivered to you or to a person you designate to receive it, except where applicable law provides otherwise. If you independently arrange a carrier that we did not offer, risk may pass when the order is transferred to that carrier, as permitted by law.

If tracking shows delivery but you cannot locate the package, contact the carrier and notify us promptly so we can review the circumstances. We do not guarantee replacement or reimbursement for theft or loss occurring after confirmed delivery, except where required by law.

Section 7 — Digital Products and Downloadable Content

Digital guides, journals, recipes, manuals, and other downloadable resources are licensed for personal, non-commercial use only. Purchasing or receiving digital content does not transfer ownership of its intellectual-property rights.

You may download and print a reasonable number of copies for your own personal use. You may not reproduce, share, resell, publish, upload, distribute, license, modify for redistribution, or use digital content to create competing commercial products without prior written permission.

Access to free downloads may require submitting an email address and consenting to communications as described on the relevant form and in our Privacy Policy. Promotional emails may be discontinued at any time through the unsubscribe link provided in each message.

Digital products that have been accessed or downloaded may not be returnable except where required by law or when the file is materially defective.

Section 8 — Intellectual Property

The Services and their contents—including trademarks, trade names, logos, text, recipes, guides, manuals, photographs, graphics, illustrations, videos, audio, product designs, packaging, and site design—are owned by or licensed to Baker’s Kitchen and are protected by applicable intellectual-property laws.

You may use the Services only for lawful, personal, and non-commercial purposes. Unless expressly permitted, you may not reproduce, distribute, modify, publicly display, republish, download, store, sell, license, or transmit content from the Services without prior written permission.

Baker’s Kitchen’s names, logos, product names, designs, and slogans are trademarks or other protected brand assets. They may not be used without prior written permission.

Shopify’s names, logos, product names, designs, and slogans are trademarks of Shopify. Other names and marks appearing through the Services belong to their respective owners.

All rights not expressly granted are reserved.

Section 9 — Optional Tools

We may provide access to tools, integrations, or services operated by third parties. We do not necessarily monitor or control these tools.

Third-party tools are provided “as is” and “as available,” subject to applicable law and the third party’s own terms and policies. Your use of them is at your discretion and risk.

Features and resources added to the Services in the future will also be subject to these Terms unless stated otherwise.

Section 10 — Third-Party Links

The Services may contain links to websites, services, or content operated by third parties.

We are not responsible for reviewing or guaranteeing the accuracy, availability, privacy, security, products, services, or practices of third parties. Accessing a third-party website or service is at your discretion and subject to its terms and privacy policy.

Questions or complaints concerning a third-party product or service should be directed to that third party.

Section 11 — Relationship With Shopify

Baker’s Kitchen is powered by Shopify, which enables us to provide the Services to you. However, purchases made from our store are transactions directly between you and Baker’s Kitchen.

By using the Services, you acknowledge that Shopify is not the seller of products purchased from Baker’s Kitchen and is not responsible for the fulfillment or performance of those products. To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from transactions between you and Baker’s Kitchen.

Nothing in this section limits any rights or remedies that cannot lawfully be waived.

Section 12 — Privacy

Personal information collected through the Services is handled according to our Privacy Policy. Certain information may also be processed under Shopify’s Consumer Privacy Policy.

Because Shopify hosts the Services, information submitted through the store may be transmitted to and processed by Shopify and relevant service providers, including providers operating in countries other than your country of residence.

Please review our Privacy Policy for additional information about how personal information is collected, used, disclosed, and protected.

Section 13 — Reviews, Feedback, and User Content

If you voluntarily submit a review, photograph, comment, suggestion, recipe variation, testimonial, or other content (“Feedback”), you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate, distribute, and display that Feedback for operating, improving, and promoting the Services.

This license does not transfer ownership of your Feedback to us.

You represent that:

• You own the Feedback or have permission to submit it;

• The Feedback is accurate to the best of your knowledge;

• You have disclosed any compensation or incentive connected with it; and

• Its use will not violate another person’s intellectual-property, privacy, publicity, or other rights.

We are not required to keep Feedback confidential, compensate you for it, publish it, or respond to it.

We may moderate or remove Feedback that is unlawful, fraudulent, abusive, defamatory, obscene, misleading, irrelevant, or otherwise violates these Terms.

Section 14 — Errors, Inaccuracies, and Availability

The Services may occasionally contain typographical errors, inaccurate information, or omissions concerning product descriptions, prices, promotions, inventory, shipping charges, transit times, or availability.

We may correct errors, update information, or cancel affected orders when reasonably necessary. If an order is canceled after payment, an appropriate refund will be issued.

Section 15 — Prohibited Uses

You may use the Services only for lawful purposes. You may not:

• Violate applicable laws or regulations;

• Infringe intellectual-property, privacy, publicity, or other rights;

• Submit false, fraudulent, defamatory, abusive, obscene, or misleading content;

• Introduce malware, viruses, or harmful code;

• Interfere with the operation, security, or accessibility of the Services;

• Attempt unauthorized access to accounts, systems, or data;

• Collect or track another person’s personal information without authorization;

• Use the Services to send spam, phishing messages, or unauthorized solicitations;

• Impersonate another person or misrepresent your identity;

• Circumvent access restrictions, security measures, rate limits, or robot-exclusion instructions;

• Scrape, copy, extract, reproduce, or exploit substantial portions of the Services for commercial purposes without permission; or

• Use the Services in a manner that harms Baker’s Kitchen, Shopify, our service providers, or other users.

We may suspend or terminate access when we reasonably believe these Terms have been violated.

Section 16 — Automated Systems and Agents

Automated systems, software agents, crawlers, and similar technologies must comply with all applicable technical restrictions, access controls, rate limits, robot-exclusion instructions, and laws.

An automated system may not conceal its automated nature, evade security measures, solve or bypass CAPTCHAs, mimic human behavior to circumvent restrictions, or continue accessing the Services after being instructed to stop.

We may restrict or block automated access to protect the security, availability, intellectual property, and proper operation of the Services.

Section 17 — Termination

We may suspend or terminate your access to the Services if you violate these Terms, misuse the Services, engage in unlawful conduct, or create a security or fraud risk.

You remain responsible for amounts properly due before termination.

Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, digital-content restrictions, Feedback, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution.

Section 18 — Disclaimers

Educational materials, recipes, baking schedules, troubleshooting information, and other content are provided for general informational purposes. Baking conditions and results vary, and we do not guarantee a particular outcome.

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee that the website will always be uninterrupted, secure, timely, or error-free.

Except for warranties expressly provided by us and rights that cannot legally be excluded, we disclaim implied warranties and conditions, including those concerning merchantability, fitness for a particular purpose, durability, title, and non-infringement.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, these exclusions apply only to the maximum extent allowed by law.

Nothing in these Terms excludes statutory warranties, consumer guarantees, or other rights that cannot lawfully be waived.

Section 19 — Limitation of Liability

To the fullest extent permitted by law, Baker’s Kitchen and its service providers, licensors, affiliates, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost savings, loss of data, or replacement costs, arising from the Services or products purchased through them.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, or other matters protected by applicable law.

Where liability may lawfully be limited but not excluded, our aggregate liability arising from a claim will not exceed the amount you paid for the product or service giving rise to that claim.

Section 20 — Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Baker’s Kitchen and its affiliates, employees, contractors, agents, licensors, and service providers from third-party claims, liabilities, damages, and reasonable legal expenses arising from:

• Your material breach of these Terms;

• Your unlawful use of the Services;

• Your violation of another person’s rights; or

• Content you submit through the Services.

This section does not require a consumer to indemnify us for our own negligence, misconduct, breach, or violation of law.

Section 21 — Severability

If a provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the greatest extent permitted and the unenforceable portion will be severed. The remaining provisions will continue in effect.

Section 22 — Waiver and Entire Agreement

Failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms and the policies incorporated by reference constitute the agreement between you and Baker’s Kitchen concerning use of the Services and supersede prior communications concerning the same subject.

Nothing in this section excludes representations or rights that cannot legally be excluded.

Section 23 — Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, transfer of the business, or similar transaction, subject to applicable law.

Section 24 — Governing Law

These Terms and disputes concerning the Services are governed by the laws of the State of North Carolina and applicable federal law, without regard to conflict-of-law principles.

Subject to applicable consumer-protection law, disputes will be brought in a court of competent jurisdiction in North Carolina.

If you are a consumer residing outside North Carolina, this section does not deprive you of mandatory rights, protections, or jurisdictional options available under the laws of your place of residence.

Section 25 — Changes to These Terms

The current version of these Terms will be available on this page.

We may update these Terms to reflect changes in the Services, business practices, or legal requirements. The revised version will display an updated effective date. When required by law, we will provide additional notice of material changes.

Continued use of the Services after revised Terms take effect constitutes acceptance to the extent permitted by law.

One substantive correction matters: I removed the statement that risk transfers as soon as you hand a package to the carrier.
